Cancer Treatment Success - December 16th, 2009 - 5 Comments

I was suspended as a patient from a cancer clinic after an angry confrontation with a clinician there …..?

My heart failed during a surgery three weeks ago and all sorts of thing went wrong (my heart is healthy – it was due to slapdash abdominal insufflation_

The upshot is that in a fit of pique a clinician and I exchanged strong words and I subsequently called the clinical director and told him I was considering a lawsuit. I told them I was leaving the medical center and had arranged to sign up elsewhere for my care.

Lo and behold three weeks later I get a letter of suspension from the medical director suggesting that my departure from the clinic was THEIR decision and not mine!

How can I rectify this and have this lie expunged from my records? I do not want this info to affect my future care at new clinic – they have expressed a concern.
The clinics are government funded and free – though I do have Medi-Cal insurance (California)

The suspension was for three months only
Mortimer: How can I be suspended if I had told them I had left? That’s absurd.

what an odd thing to say – I am not obese and the team (cardiologist, anesthesiologist and a new surgeon said I was insufflated too quickly and had a vagal nerve reaction which happens occasionally) I am not disputing the actions of the surgeon.

    Write a letter back to the medical director, setting out the facts (i) as to your decision to depart, and (ii) countering his/her statements as to the reason for your departure.

    I’d contact a disability organization and/or disability attorney.

    The fact that you chose to go to another clinic does not alter the fact that your behavior was outside their accepted range of action. They can suspend you from the clinic even IF you have no intention fo going back.

    It’s on your record, and i can’t see it being removed, since it sounds valid.

    If you have any problems, simply explain the situation.

    YOU goofed.

    You made threats and made comments about leaving verbally. Nothing in writing. So what proof do you have that the decision was yours and not theirs? They at least have something in writing.

    And FYI if you are grossly obese the abdominal inflation problem may have been due to your gross obesity. It is kind of hard to inflate a grossly obese patient.
