My friend has cancer and I want to help his mom get a visa to be here with him during Chemo?

He has cancer, and is going to start his Chemo soon. His mom is here with a European passport, but is running out of the allowed time to stay. Is there any extension, or special parole she can apply for to stay a few more months? He doesn’t have any family in the US. Thanks!

    well, she could actually apply for humanitarian parole through USCIS. she can’t extend the visa itself if she came on Visa Waiver. If she came on a tourist visa, she could apply for an extension by filing an I-539. however, given that she is almost out of time already, if she came on Visa Waiver, she’d probably be better off leaving and then applying for a tourist visa back home. that way she could stay for up to 6 months, and would be able to file for an extension if it proved necessary later.

    if she is on a visa waiver she will have to return home and apply for a B-2 at her local consulate ..
    she must not overstay by one day ..or its no return.

    If she came on the Visa Wavier Program, no, there’s nothing she can do. No extension is possible on the Visa Waiver.

    If she overstays by even 1 single day she’ll never be allowed to use the visa waiver again.

    It does not seem to be possible. Unfortunately form I-539 cannot be used if admitted on a visa waiver.
